Terms & Conditions

1. Agreement

These Terms & Conditions govern your use of the PestGuard platform operated by PestGuard International (Pvt) Ltd. ("PestGuard"). By creating an account, accepting an invitation, or paying a subscription fee, you agree to these terms on behalf of your company.

2. Accounts and company workspaces

  • The person who registers a company becomes its owner and is responsible for that workspace, including all invited users.
  • Owners and admins may invite, promote, or remove users. Users invited by email belong strictly to the inviting company.
  • You must provide accurate registration details, keep credentials confidential, and notify us promptly of any suspected unauthorised access.
  • Each company's facilities, floor maps, devices, and inspection records are isolated and are not visible to any other company.

3. Subscriptions, trial and payment

  • Newly registered companies receive a one-month free trial from the date of registration.
  • After the trial, continued access requires an active paid plan (Tier 1 for up to 3 users, Tier 2 for 4–10 users), billed monthly or annually in Sri Lankan Rupees (LKR).
  • Payments may be made online via PayHere or by bank transfer with a proforma invoice and uploaded payment slip. Bank-transfer access is granted after our review of the slip.
  • Fees are exclusive of any taxes or bank charges unless stated otherwise. Refunds are governed by our Refund Policy.
  • We may suspend access to a workspace whose subscription has lapsed. Your data is retained for a reasonable period so you can reactivate.

4. Acceptable use

You agree not to:

  • Upload unlawful, infringing, or malicious content, including malware;
  • Attempt to access another company's data, bypass authentication or authorisation, or probe, scan, or test the platform's security without written permission;
  • Resell, sublicense, or provide the platform to third parties outside your company without our written consent;
  • Interfere with platform availability, scrape it at scale, or reverse engineer it except as permitted by law;
  • Use the platform to store data you have no lawful right to process, or in breach of applicable food-safety, pharmaceutical, data-protection, or export laws.

5. Your data and compliance responsibility

You retain ownership of the data you upload, including facility layouts, device coordinates, and inspection records. We process it only to provide and support the service. PestGuard is a record-keeping and reporting tool: you remain solely responsible for your pest management programme, the accuracy of logged inspections, and your compliance with FSMA, GMP, BRC, SQF, or any other standard or regulator. Reports generated by the platform are not certifications or regulatory approvals.

6. Availability and support

We work to keep the platform available and secure but do not guarantee uninterrupted operation. Planned maintenance, third-party infrastructure incidents, and events beyond our control may cause downtime. Support is provided by email during Sri Lanka business hours.

7. Limitation of liability

To the maximum extent permitted by law, PestGuard is not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost business, audit outcomes, regulatory penalties, product recalls, or loss of data. Our total aggregate liability arising out of or relating to the service is limited to the subscription fees you paid to us in the three months preceding the event giving rise to the claim. The platform is provided "as is" and "as available" without warranties beyond those that cannot be excluded by law.

8. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for non-payment, breach of these terms, or unlawful use. On termination, your right to access the platform ends; you may request an export of your company data before deletion.

9. Changes and governing law

We may update these terms; material changes will be notified in the app or by email, and continued use constitutes acceptance. These terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have exclusive jurisdiction.
